Thank you for choosing Wonderland Party Entertainment (WPE) for your event. By engaging the services of WPE for an event, you (the purchaser) expressly acknowledge that you have read, understood, and agree to be bound by the below Terms and Conditions (T&Cs).
WPE will only attend, perform, and provide any services at an event on the condition that you have agreed to the following T&Cs. These T&Cs apply to all events or for the supply of any other goods or services provided by WPE to the purchaser, prevailing over any other representation to the contrary, oral or otherwise.
1. Deposit & Payment Terms:
WPE does not accept tentative bookings. All confirmed bookings require a specified non-refundable deposit, payable on the day of receiving an event Invoice. The deposit serves as a security fee and, while non-refundable, is transferable in the event of modifications made to a booking at the request of the purchaser prior to 7 days before the originally scheduled event date. WPE will make every effort to accommodate a new event date request however cannot guarantee availability.
Full payment of the event Invoice is due to WPE’s specified bank account, by electronic bank transfer, or another nominated method, no later than 7 days before the event. Failure to pay may result in event cancellation until proof of payment is provided and approved by WPE.
2. Cancellations & Limitation of Liability:
Cancellations must be made in writing or by e-mail. If cancelled less than 7 days prior to the event, the fee is 100% of the event Invoice. Cancellation over 7 days from the event results in the loss of the deposit, which is non-refundable unless WPE cancels or parties agree otherwise.
Replacement options for an unavailable WPE entertainer may be offered. WPE's liability is limited to the event Invoice paid. WPE disclaims responsibility for any incurred loss, damages, or consequential losses arising from the absence or perceived performance quality of the WPE entertainer.
3. Bump-in / Setup:
The bump-in time for a WPE entertainer at any event is relative to the event or venue/location being attended. If the WPE entertainer is required to be set up earlier than the agreed event start time, an additional early set-up cost may be incurred and added to the event Invoice.
4. Overtime:
A request by the purchaser for an extension to the previously agreed event duration, may be accommodated at the sole discretion of WPE. Any agreed extension to a scheduled event time is referred to below as overtime. Overtime will be charged at a cost of the hourly booked WPE entertainer's rate. Payment for overtime must be settled by the purchaser at the conclusion of the event.
WPE notes that it is preferable that, if there is a possibility that a purchaser may wish to extend their booking to overtime, the purchaser informs WPE more than 48 hours prior to the event commencement to confirm that the WPE entertainer booked is available to continue beyond the scheduled event time to avoid any disappointment. While all efforts will be made to accommodate an overtime request, WPE reserves all rights to reject an overtime request by the purchaser for any reason whatsoever.
5. Additional Attendees Fee:
WPE package prices cover a flat rate for up to 20 children per entertainer, inclusive of the birthday child. Beyond this limit, a supplementary fee of $5 per additional child applies. If the event exceeds 30 children, the engagement of a second entertainer is advisable incurring an additional fee; otherwise, the $5 per additional child fee remains in effect, though it is important to note increased levels of attendees may impact the quality of interaction and access to the entertainer’s services for each child.
Payment of any additional attendee fees must be settled by the purchaser at the conclusion of the event if not listed within the event invoice.
6. Parking Fee:
A suitable parking area must be provided in close proximity for the unloading and loading of our equipment. The venue/location hosting the event should ensure convenient and direct access for bump-in and pack-down. Parking fees incurred by a WPE entertainer or WPE during the event will be payable by the purchaser.
Payment for any fees related to parking incurred by the WPE entertainer must be settled by the purchaser at the conclusion of the event.
7. Travel Fee:
WPE provides services for events in the Greater Melbourne area, and complimentary travel is included within a 30-kilometre radius from the Melbourne GPO. However, for venues or locations situated beyond this initial 30-kilometre radius, a travel fee of $20 will be applied for every additional 10 kilometres. This extra travel fee extends the coverage by another 10 kilometres (measured as the crow flies).
8. Outdoor Events:
The purchaser shall be liable for any injury or damage to the WPE entertainer, their or WPE's equipment while bumping-in, attending, or packing down the event (unless such damage or injury is contributed to or caused by WPE or the WPE entertainer, in which case liability of the purchaser shall be reduced to the extent of the contribution or causation by WPE or the WPE entertainer).
WPE will use its reasonable endeavours to continue an event during an inclement weather event. If the event is located outdoors or partially outdoors, WPE and the WPE entertainer fully reserve the right to stop or cancel the event if, in WPE's sole opinion, the weather poses a potential danger to the WPE entertainer, their or WPE's equipment.
For all outdoor performances, the purchaser shall, at their own cost, provide or cause to be provided a marquee or overhead shelter to adequately cover and protect all WPE or the WPE entertainer's equipment. WPE reserves the right to cancel the event where the protective cover provided by the purchaser is not, in WPE's sole opinion, adequate.
9. Price Variations:
While every effort is made to maintain prices as quoted, invoices may be subject to an increase without notice as a consequence of additional requests of the purchaser, requirements for the event, or unforeseen circumstances. This includes but is not limited to: paid parking, induction fees, early or difficult bump-in, and additional time requirements.
If the purchaser reduces the amount of time than was originally booked on the event Invoice, WPE is under no obligation to reduce the amount of the event invoice. For the avoidance of all doubt, the full amount of the event Invoice is due to proceed with the purchaser’s event under all circumstances.
10. Conduct:
WPE does not tolerate any violent, aggressive, or abusive behaviour from any person at a venue where a WPE entertainer attends an event. If at any time WPE or the WPE entertainer feels that their personal safety or the safety of their or WPE's equipment is under threat, then WPE and the WPE entertainer fully reserves the right to terminate the event at any time. In these circumstances, no refund for the event will be provided, and the deposit will be forfeited in full.
The supervision, safety and wellbeing of attending children and other guests fall under the responsibility of the purchaser, absolving WPE and its entertainer from any liability. A suitable parent/adult must, throughout the event where a WPE entertainer is in attendance, be tasked with supervising children present at the venue/location. Please note WPE is not a child-minding service.
By agreeing to these T&Cs, the purchaser warrants to WPE that it is responsible to WPE and any WPE entertainer for any harm caused to any WPE entertainer their or any WPE equipment by any person at the venue/location hosting the event (whether a guest or otherwise).
11. Privacy
The purchaser hereby authorises WPE to collect, retain, use, and disclose consumer and/or commercial information about the purchaser in accordance with the Privacy Act 1988 (and its subsequent amendments). This information may be disclosed to solicitors or other professional consultants engaged by WPE, debt collectors, credit reporting agencies, or any individuals or organisations maintaining credit references or default listings.
Testimonials and media, encompassing photographs, artwork, and stories, may be featured on WPE’s website, social media platforms or in printed materials. The use of only first names and the purchaser’s suburb in testimonials is standard practice unless otherwise specified. The purchaser retains the option to request in writing the non-disclosure of media or testimonials on WPE websites, social media platforms or in printed materials.
12. Force Majeure
WPE is not responsible for any failure to perform any obligation under these T&Cs if its performance has become impossible due to any matter beyond the reasonable control of WPE. Such matters include (but are not limited to): fire, flood, storm, earthquake, riot, civil disturbance, natural disasters, national emergencies, pandemic, government interference, theft, crime, strike, lockout, breakdown, war, or the inability of WPE's normal suppliers to supply necessary matter beyond the reasonable control of WPE. In such circumstances, WPE will be under no obligation to refund the deposit or event Invoice.
13. Laws of Victoria:
The T&Cs are governed by and interpreted in accordance with the laws of the State of Victoria, Australia. The purchaser irrevocably submits to the non-exclusive jurisdiction of the Courts of the State of Victoria, Australia. If any provision of the T&Cs is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this agreement, which will continue in full force and effect.
If any part of these terms is found to be void, invalid, unlawful, or unenforceable, then that provision or part will be deemed to be severed from these terms, and the remaining terms and provisions of these terms will remain in force and constitute a binding agreement between the purchaser and WPE.
14. Changes to Terms and Conditions:
WPE reserves the right to amend these terms and conditions at its discretion and with at least 28 days’ notice. In the event of any amendments, the revised terms and conditions will promptly appear on the WPE website as notice and enter into effect after 28 days of being published. The onus is on the purchaser to stay informed about any changes by checking the latest information contained on the WPE website.
